I believe that each toll service provider should have posted regulations defining how the # of axles is determined for purposes of calculating toll fees.

Up here in Québec, I recall reading one of the local toll road regulations where axle count is determined by the number of times a light beam is tripped.

Vehicle height is another variable that is often used here in Quebec to further determine toll fees.

A car pulling a single axle utility trailer (total of 3 axles) will pay less than a TZE due to height differences. A full size van exceeding 6ft in height pulling the same trailer will pay the same as a TZE.

Here in Quebec, the toll roads are all privately owned and operated. They all use transponders. Vehicles without the required transponder are photographed and an invoice sent to the vehicle owner. The fee for those vehicles is typically ~3 times more than regular transponder fees. The reasoning is that it requires "human" intervention to process the paperwork.
