What Sully said. Worst they can do is say 'no'. The defense is hoping you won't show up, and their man will walk. Another thought... isn't as important here, but might be elsewhere, particularly when the other party is insured. Consider any conversation - even with your own adjuster - as an adversary relationship. i.e. say nothing till you've had a bit to think the whole thing out. "Are yall OK?" elicits a response, and if it's "Yeah" you've jepoardized any claim in the future for hidden injury. "We have him on a recording saying he's okay". Remember, the insurance person's job is to not give out money, and to minimize any giveout that's made.

Like my ol' daddy the judge used to say 'argue in my courtroom, not out by the highway... that's what it's for.'
